ORDERING FROM THE WEBSITE: We accept all Major American Based Credit Cards and also offer our Customers access to PayPal to process credit card orders if they choose. PayPal uses high security processing, so when ordering from our website using PayPal, you will be asked to provide the billing address of the credit card you are using and your Items will be shipped to your billing address if you use PayPal also.
A 5% service fee is added when purchasing using PayPal.

CANCELING ORDERS BEFORE THEY ARE SHIPPED OUT.
The credit card processing companies used for purchases, do not refund their processing fees when we refund money for a purchase someone wishes to cancel. Therefore, any orders that are canceled by the Buyer before shipment of the product, the 2.9% credit card processing fee we were charged will be deducted from the refunded purchase amount. We cannot be responsible for paying the processing fee for cancelled orders. So before ordering anything, please make sure you are not going to want to cancel the order. That way you can avoid being charged the credit card processing fees that were charged and are not refundable. (Example sale: $1000.00 = $29.00 processing fee that gets charged that is not refunded when we give someone a refund for canceling their order before shipment.)

PLEASE DO NOT ACCEPT ITEMS THAT HAVE RECEIVED SHIPPING DAMAGE OR IF THE CONTAINER WAS RIPPED OPEN AND RE-SEALED BY THE CARRIER, UNLESS YOU KNOW YOUR ORDER IS COMPLETE.
IF A CARTON LOOKS BLOWN APART AND IS RE-TAPED TOGETHER, DO NOT ACCEPT IT IF YOU THINK ITEMS MAY BE MISSING FROM IT.
ALL U.P.S. AND OTHER SHIPMENTS ARE INSURED UNLESS YOU ACCEPT IT “AS IS” WITHOUT NOTING THE PROBLEM WITH THE DRIVER AND GETTING A SIGNED RECEIPT FROM HIM MENTIONING THE DAMAGE YOU FOUND.
SMITTY’S WILL NOT REPLACE LOST/DAMAGED ITEMS CAUSED BY THE DELIVERY COMPANY UNLESS WE CAN RECOVER THE INSURANCE LOSS.
If you do accept damaged goods, it is your responsibility to report any damaged or missing parts or equipment you accepted to the freight carrier immediately. Note the damage on the “Bill of Lading” or with the U.P.S. Driver, this is important! (If it’s just a paint touch-up that is needed, the Manufacturer may send touch-up paint, so don’t refuse an item because of slight cosmetic issues)
Please be aware that freight carriers have very strict requirements on equipment damaged in transit. If you suspect a product you received is damaged and you accept it anyway, make note of the damage on the delivery slip (Bill of Lading) from the carrier when you sign for the delivery, the Driver should sign the slip as well and should sign your COPY.
Manufacturers do not consider shipping damage as a Warranty item, so you must report damaged items you accepted to the freight carrier within 7 days to make a claim, but the sooner the better. It is the responsibility of the Buyer to report this to the Carrier so they can reimburse you directly for items they damaged while they were in transit.

Delivery of any purchased items will be considered “complete” at the time the shipment is received by the carrier from the warehouse location affiliated with the product. Ownership will pass to Purchaser at the time of pick-up by the Delivery Carrier from our warehouse or when shipped from any other originating warehouse. UPS Tracking numbers or Freight Company PRO numbers will be provided upon request so you can track your property during its shipping process.
Do not accept items if damaged, proper delivery is the Carriers responsibility.

HAVEN’T RECEIVED YOUR ITEMS YET?
If you don’t receive your property within a reasonable time frame, please call Smitty’s Equipment Sales, (630-678-9010) and we will contact the shipping company with the tracking number and find out what the delay is. We can help you by providing you the UPS Tracking numbers, Freight Company PRO numbers and the Shippers phone number, but please don’t be angry with us if the Shipper isn’t moving fast enough, we have no control over their businesses.
Items that are priced as “Delivered” or “Free Shipping” means Smitty’s will ship to the Customers requested shipping destination once for each order placed only.
LOST SHIPMENTS: All shipments are insured by Smitty’s for the replacement amount. When the Shipping Company judges that a shipment is actually “lost” and a credit is forthcoming to Smitty’s for any items lost, Smitty’s will replace the item at no charge to the Customer. Please be patient while this process is accomplished. Of the thousands upon thousands of shipments made in the last 10 to 12 years, Shipping Companies have only really “lost” three of the smaller boxes, so there is an extremely slim chance a shipment from Smitty’s warehouse won’t reach its destination within a reasonable amount of time and be located with its tracking number they provide.
SHIPPING DELAYS: All Delivery Times Are Estimated
95% of the orders we receive are processed and shipped within 24 hours unless they are backordered or specially made items. Smitty’s Equipment Sales cannot guarantee that orders being ”drop-shipped” from a manufacturer’s warehouse or shipped from our warehouses will arrive at the designated location by a specific day or hour. All we can do is make sure the items are picked-up from one of our shipping locations ASAP, usually within 24 hours of the order being placed.
Regarding Drop-Shipped Orders:
Smitty’s has no control over any Manufacturer’s In-warehouse shipping procedures, truck load scheduling, loading procedures or Freight Company they choose to ship equipment or parts. We can have them ship parts overnight or at a faster than “Regular Ground” UPS or FedEx Rate, but Buyers are responsible for fees incurred on the quicker shipping rates. We are not responsible for delivery time-consuming delays caused by Snowstorms, Tornados, Flooded Roads or any other adverse weather or hazardous road conditions Drivers may encounter while hauling their load to your destination. Smitty’s has no control over any arrival times. Delivery of purchased items will be considered “Complete” at the time of shipment pick-up from Smitty’s Equipment Sales warehouse locations or when shipped from any other originating warehouse. Ownership will pass to Purchaser at the time of pick-up by the Delivery Carrier from the warehouse. UPS Tracking numbers or Freight Company PRO numbers will be provided upon request so you can track your property during its shipping process.

“Free Shipping” or Orders marked “Delivered”:
Orders under 150 lbs. usually ship “UPS Ground”. If you want your Free Ground shipped order processed for “over-night shipping” or shipped quicker than the free ground shipping some orders may provide, you can upgrade your order by paying for the quicker class of shipping. Call 630-678-9010 to do this, and place your order over the phone.
Orders that you prefer to ship special delivery:
For instance, UPS Next Day Air, UPS Next Day Air Saver, UPS 2nd Day Air or UPS Three-Day Select must be processed at the time the order is being placed.
Call 630-678-9010 to get a shipping quote and to place your order at the same time.
You will be given the date and approximate time that UPS gives for your delivery. A tracking number can be provided after the purchase leaves the Warehouse.
NOTE: Vehicle Lifts, Air Compressors, Tire Machines and other larger heavier items always ship “Truck Freight” by a common carrier. Lift-Gate service is usually available for an added fee and must be added at the time the order is placed.

EQUIPMENT & LARGE PARTS RETURNS:
Refunds will be processed for any items returned within 15 days from purchase, return freight paid by Purchaser. (So please don’t wait 20 days or more to call and ask to return a product or part, we do not accept returns after 15 days from purchase) A Restocking fee of 25% will be charged for any returned items that were marked “Free-delivery” or “Delivered” when they were purchased.” Free Delivery” is not free for Smitty’s, the shipping expenses were paid for by Smitty’s and should be reimbursed as part of the “restocking fee” on returned items. We don’t mind paying for shipping if the Purchaser keeps the item they bought. However, we don’t believe in paying for shipping an item to someone if the “sale” is being cancelled and the item is returned for a refund.
Smitty’s Shipping costs will be deducted from any refund given.
“Delivered” and “Free Shipping” is contingent upon the Purchaser KEEPING the items they bought.
If an item is returned, there is no more free shipping on it

OTHER PARTS RETURNS:
ELECTRICAL PARTS ARE NOT RETURNABLE IF THE PLASTIC BAG THEY WERE IN HAS BEEN OPENED OR IF ELECTRIC WAS APPLIED.
POWER UNITS & ELECTRIC POWER UNIT MOTORS ARE NOT RETURNABLE IF THEY HAVE BEEN HOOKED UP IN ANY WAY TO AN ELECTRICITY SOURCE.
Refunds will be processed for any parts returned within 15 days from purchase, Purchaser is responsible for return shipping fees.
Returns shipped COD will not be accepted by our receiving department.
Before returning any product, you must call contact us for a return authorization “RA” number.

After the item being returned has been inspected and tested for problems a credit will be issued if it is deemed “Re-sellable NEW” If the item is defective or not considered new anymore a refund will not be given.
If an item was returned and shows after inspection that electricity was connected improperly causing a motor failure or other problem, that item is not covered, the Customer will be informed that the item is ready for them to arrange pick-up if they still want the item. Smitty’s is not responsible for “Shipping costs back to the Purchaser” on items that do not pass returns inspection and are not eligible for a refund. They can be repaired by Smitty’s at the Customers discretion and expense and shipped back to them.
We claim no responsibility for any incorrect repair diagnosis or misinformation by others or wrong or unneeded parts being ordered by anyone, unless we specifically made a order error ourselves and sent you a part that is not listed on your sales receipt.
Custom made parts or specially ordered unusual parts, we normally don’t stock, or a part we have to have made, or obsolete parts are non-returnable.
So make sure you really want them before ordering these kinds of parts. You will be informed at time of quote whether the part has to be made or not.
Before returning any product, you must email us at smitty@smittysequipmentsales.com for a return authorization “RA” number. Refunds will be processed for any parts returned within 15 days from purchase, freight prepaid by Purchaser. (So please don’t wait a month or more to call and ask to return a product or part.) Returns sent back without an “RA number” will be charged a 30% repackaging, restocking fee instead of the usual 15%, 20% or 25%, so email us before sending something back and reduce your restocking/repackaging fee please.
The Purchaser is responsible for any return freight costs.
We do not accept collect or C.O.D. shipments.

Orders paid by check or with Credit Card for Automotive Equipment.
Will be charged up to 25% cancellation fee, depending on what our Vendor charges us to cancel an item that is already in production or has been ordered for shipment when it comes into warehouse.
So, please make sure you want something ordered before you pay for it, because items that have to be built or ordered by the Manufacturer have a cancellation fee if you decide to cancel it after it’s already been ordered from the manufacturer.
TAXES
Prices shown do not include any applicable sales taxes. Illinois and California Sales Tax will be added automatically to orders from Customers. Customers outside of Illinois and California are responsible for paying any taxes owed to their State, County, Parish or Municipality in which they reside. All shipments made within the State of Illinois will be charged 8.5 % sales tax and California 8%.
Rotary Lifts charges sales tax on all orders being drop-shipped from Rotary’s Location to all States but OK, AL, NH & DE. Sales Tax on Rotary Lifts will be applied except for the four States listed. BendPak Lifts charges sales tax on any drop-shipped products into California. Challenger Lift charges sales tax on drop-shipped items into Kentucky.
There are other Manufacturers that have similar tax policies as well on drop-shipments.
“DELIVERED” Means…

“Delivered” on BendPak/Ranger items means FREE SHIPPING to direct points within 48-contiguous states.

NOTE TO BUYER: “RATZ” (Rural Area Transportation Zone) Fees that are charged by BendPak/Ranger are not covered in the “Free Delivery” links on this website. Transportation and shipping to these remote and rural locations are non-direct shipping points with higher associated delivery costs. Your ZIP code will determine whether your location is designated “RURAL” or not. Check to see if a RATZ* surcharge will be added to your order.
If it is on the list, the RATZ fee charged by BendPak is 5.0%.
NOTE! BendPak orders drop-shipped to Illinois or California from BendPak are subject to State sales tax.
Repair parts usually ship within 24 to 48 hours unless it’s a backordered part or has to be made. Please allow additional time for parts that are out of stock or must be made.
Most other equipment (i.e. lifts, compressors, tire machines, etc.) usually arrive within 7 to 14 business days of placement of order. FREIGHT DELIVERIES
“Delivered” does not include “Unloading”
Some larger items, such as vehicle lifts, will require a forklift or other means for unloading at the Buyers location. Unloading the truck is strictly the responsibility of the Buyer. Trucking Companies call before delivering the equipment and that is the time to coordinate your unloading schedule with the driver that has the bill of lading with him. That way you know exactly what he has that you will be unloading and when.
In some cases, it is recommended that the buyer pick up the product from the carrier’s freight dock or some other nearby location they choose if means to unload a semi-truck at the point of use is not available.
Smitty’s Equipment Sales does not export items to other Countries
and will arrange delivery of automotive shop equipment within the USA borders only. What a Customer does with their property after receiving it is entirely their own business and Smitty’s Equipment Sales does not get involved with any other export arrangements or responsibilities. We will not communicate with export transportation service companies, so please don’t ask us to if you decide to export something after you received it from us. Any information about the product purchased will be given to the Customer so they can make their own decisions.
EQUIPMENT INSTALLATION
Vehicle Lifts, Air Compressors & Air piping, Reels and Pumps.
Pricing to assemble lift kits, depend on style of lift being assembled and having Customer receive lift kit before our arrival. Hauling of lift kit from our warehouse to the installation site adds more to the cost. Some lift kits do cost less to assemble, while others cost more. You must also have to take into consideration the concrete condition, floor levelness and other possible variables, such as in-floor heat, sewer and electric piping location. All these change the cost of the installation and we are NOT responsible for damage to “In-Floor” heating systems. The floor should be close to being level or extra shimming costs will be added to the installation fee if the kit can even be installed in that spot in your building.
We are not responsible for inadequate information being given to us for your quote.
LIMITS OF LIABILITY
Seller provides no warranties other than in accordance with the Manufacturer’s written limited warranty accompanying the particular product sold. In no event shall Seller be liable for special, consequential, or incidental damages or injures of any kind or nature whatever, including but not limited to loss of profit, rental of substitute equipment or other commercial loss, for the breach of or delay in performance of the Manufacturer’s Warranty.
In no event will Seller’s liability exceed the original price paid for the product.
We claim no responsibility for any incorrect repair diagnosis or misinformation by others or wrong or unneeded parts being ordered by anyone, unless we specifically made an error ourselves and sent you the wrong part other than the part you asked for.
Prices on our website may be updated at any time. We do not guarantee today’s prices to be the same as tomorrows unless a current sale has an expiration date, or you get a quote from our office. We reserve the right to cancel any order that may have an extreme pricing error or technical pricing error in the button code on the website.
Please “refresh” the web page to see the most current pricing information.
Occasionally prices may change, but computer browsers don’t always “refresh” the page when you open the page unless you have them set to do so. To avoid purchasing something and paying an “old price” by mistake, please refresh the page in your browser to ensure your order doesn’t get cancelled due to the price being out of date.
If you buy something from a non-refreshed page and the price is different than the new price, we will refund your money immediately. However, if the price was lowered and you paid a higher price do to buying from a non-refreshed page, we will issue you a refund of the amount you would have gotten in savings at the lower cost plus ship your item to you promptly.
WARRANTIES
All equipment ships with the Manufacturer’s full warranty. The Manufacturers of the equipment sold on this site provide warranties to the end user. No express or implied warranties, with the exception of those given by the manufacturer, are claimed or recognized by Smitty’s Equipment Sales. We will assist the purchaser in any issues regarding warranty for products purchased through our site, but the manufacturer must make the final determination of warranty.
Any litigation, claims or disputes brought against Smitty’s Equipment Sales, must be made in the State of Illinois, County of DuPage. By purchasing a product from this site, or directly from Smitty’s Equipment Sales, Division of Blizzard Wizzard’s Snowplowing Incorporated, you are agreeing to abide by these terms and conditions.
SECURITY AND CONFIDENTIALITY
Smitty’s Equipment Sales agrees to hold all information from the purchaser in the strictest confidence. No private information (name, address, phone number, customer I.D., etc.) shall be shared with any other entity, other than for shipping the requested product or to conduct business with said customer.
Smitty’s Equipment Sales does not store credit card information resulting from purchases made by telephone. Our website uses High Security Credit Card Processing as well as “PayPal” to process credit cards from website purchases, and at no time will your data be shared with outside sources, in fact, PayPal does not share your credit card information with Smitty’s either.
